MAKE-UP CLASSES
Students enrolled in Vulcana classes are able to attend a make-up class for a missed class, provided it is taken in the same term as enrolled (eg a class missed in term 2 must be made up in term 2).
Exceptions to this may apply, for instance, when the last class of term is missed or a student is attending multiple courses and is therefore unable to attend a make-up class in the same term. In this instance, students must use their make-up class in the following term and must also be enrolled in at least one course (eg a make-up class from term 2 can be used in term 3 provided the student is enrolled in a course in term 3). Students must contact the workshops coordinator to discuss as close to the missed class as possible. Classes not used, according to the above terms, will be forfeited.
Students doing make-up classes must attend a class which is relevant to the course they are enrolled in. It also must not exceed the skill level of the student, i.e. an intermediate student can attend a beginner or intermediate level class relevant to their course, but cannot attend an advanced level course (unless previously discussed with the workshops coordinator that this course is suitable for the student).
Make-up classes cannot be used for masterclasses, private lessons or special courses. Course must meet a minimum number of paid enrolments for the course to proceed.
If more than 3 make-up classes are taken throughout the term (unless previously discussed with the workshops coordinator) then this may fall into class credit instead.
No admin fee currently applies to make-up classes unless they are issued as class credit.
CANCELLATIONS
Refunds- student cancellation:
Due to the current climate surrounding Covid, Vulcana has updated their refund policy.
Vulcana will no longer issue monetary refunds for class cancellations.
You can choose to protect your ticket with a Refund Upgrade if you’re unable to attend a class.
This is an optional add on, if you choose to add it to your cart at the final checkout stage, it will be an additional 10% of the cart total.
If you cancel before the class with refund protection, you will get a full refund as well as the Refund Upgrade fee. This will cover you for a variety of reasons including Covid infection isolation and family illness, home emergency, public transport or private vehicle failure and more.
If you do not choose a refund upgrade, you will not be eligible for a monetary refund, however you can still apply for class credits for your course.
CLASS CREDITS
If you need to cancel your class, you can apply for class credits. This is a credit to the amount of unused classes that can be used to book future classes anywhere in the following 12 months.
Credits apply from the date the student or representative notifies Vulcana, except in the instance where a medical certificate can be provided. Medical Certificates are able to be back dated to include any classes already missed due to medical reasons. In this case, credit applies from the date of the first class missed that is covered by the medical certificate.
The following administration fees apply to all credits:
-10% where a medical certificate cannot be provided.
Partial refunds apply if a course is partially used.
Refunds- Vulcana cancellation:
If Vulcana is required to cancel a course – for various reasons including, but not limited to, low enrolments, weather conditions, change of venue availability, etc – the student is entitled to a full refund of the course or part thereof which was cancelled, if a suitable alternative cannot be arranged (transfer to another class, rescheduled dates, etc).
Partial refunds apply if only part of the course is cancelled.
Class credit can also be issued and is valid for 12 months from the start date of the cancelled course.
No administration fees apply in this circumstance.
OUTSOURCED WORKSHOPS
FINANCIAL AGREEMENT
Workshop fee
The Customer will pay the invoice to Vulcana Circus within the timeframe stated on the invoice, in the method specified by Vulcana Women’s Circus.
Cancellation of booking by Vulcana Circus
If the Customer fails to pay the Deposit in accordance with Terms and Conditions contained herein, Vulcana Women’s Circus may terminate this agreement by notice to the Customer.
Cancellation of booking by Customer
The Customer may terminate this agreement by providing written notice to Vulcana Women’s Circus in accordance with the following:
If the date of termination, being the date the written notice, is received by Vulcana Women’s Circus is:
(a) more than one (1) months before the commencement date of the Event, Vulcana Women’s Circus shall refund the full Deposit to the Customer;
(b) more than one (1) week but less than one (1) months before the commencement date of the Event, Vulcana Women’s Circus shall refund 75% of the Deposit to the Customer and the balance (25%) of the Deposit shall be forfeited to Vulcana Women’s Circus on and from the date of termination;
(c) less than one (1) week before the commencement date of the Event:
(i) the full Deposit shall be forfeited to Vulcana Women’s Circus on and from the date of termination and the Customer is not entitled to any part of the Deposit;
(f) less than one (1) week before the commencement date of the Event:
(i) the full Deposit shall be forfeited to Vulcana Women’s Circus on and from the date of termination and the Customer is not entitled to any part of the Deposit, and
(ii) the Customer must immediately pay a cancellation fee equal to the entire Event Charges for the Event to Vulcana Women’s Circus.
Vulcana Women’s Circus may recover from the Customer as a liquidated debt any part of the Deposit or any cancellation fee (which may be equal to all or part of the Event Charges) which is not paid when required.
The Customer agrees to carry out at its own expense in all things the event set out in the Agreement. In addition to the costs and expenses incurred in the said event the Customer shall, at the conclusion of the Event, pay to Vulcana Women’s Circus all other additional charges in respect of staffing, cleaning, waste disposal, use of facilities and equipment, ticketing, promotions, advertising, reparation or making good any damage or loss and any other expenses of any kind incurred or sustained by Vulcana Women’s Circus pursuant to or purporting to be pursuant to the Event.
Loss or Damage to Goods
The Customer agrees and undertakes to pay to Vulcana Women’s Circus on demand:
· the amount of any loss or liabilities incurred or sustained by Vulcana Women’s Circus as a consequence of or arising out of the Event including keys, or sounding of alarms due to inappropriate use;
· the cost of repairing or making good any damage to the Venue, the Event Venue or the facilities or the loss of or damage to any equipment (including the air-conditioning plant, the electric plant and/or electrical fittings), furnishings or other items arising out of or incidental to the Event, whether wilful or otherwise and whether founded in negligence or otherwise, by the Customer or its personnel or any other person entering the Venue as a consequence of the Event including a patron attending an event.
Should the Customer fail to pay to Vulcana Women’s Circus the cost of repairing or making good any damage referred to above, Vulcana Women’s Circus may recover the said costs from the Customer as a liquidated debt.
RISK, INSURANCE, INDEMNITIES AND EVACUATION
Increase of Risk
The Customer and its agents will not without the prior approval of Vulcana Women’s Circus do or suffer to be done anything in the Event Venue (when the Event is at Vulcana Women’s Circus base) whereby any policy of insurance on the Venue or its facilities or equipment may become void or voidable or whereby the rate of premium thereon may be increased. The Customer will pay to Vulcana Women’s Circus in advance all amounts payable by way of costs or increased insurance premiums on any policy of insurance so affected.
Insurance
The Customer will insure their goods and will produce proof of such insurance to Vulcana Women’s Circus upon request.
Indemnities
The Customer hereby indemnifies and agrees to keep indemnified the Owner and Vulcana Women’s Circus from and against:
all claims actions demands losses damages costs and expenses for or in respect of which the Owner and Vulcana Women’s Circus or their agents may be liable or become liable in respect of or arising from:
1. any accident loss theft damage or injury to any persons or property by reason of any act, default, omission breach of duty or breach of statutory duty on the part of the Customer, its agents and invitees or by any person entering the Event Venue as a consequence of the Event including a patron attending an event, whether founded in negligence or otherwise; or
2. a Venue staff acting under the direction order or control of the Customer or its agents in connection with the Event whether founded in negligence or otherwise;
3. any other claim action demand loss damage or cost of any kind that is consequent upon the carrying out or not carrying out, as the case may be, of the Agreed Use or Event.
Evacuation
The Customer agrees when requested by Vulcana Women’s Circus to insert into any program or to otherwise announce any emergency evacuation procedures as may be determined by Vulcana Women’s Circus.
The Customer shall comply with all directions given by the Chief Fire Warden in any way relating to the conduct of the Event Venue and shall comply with all rules, regulations and directions with regard to fire precautions.
At no time shall any fire exits, fire escapes and routes, aisles, seating rows and public access routes be obstructed in any way by any sound or visual recording or any other equipment.
CIRCUS EQUIPMENT / VENUE LAYOUT
If any of equipment is damaged during the course of the Event, beyond regular wear and tear, as a result of misuse and in direct contradiction to the guidance given by Vulcana Women’s Circus staff, the Customer must pay the cost of the damage plus an additional administration fee of $200
No rigging or use of any other equipment is undertaken without express permission from Vulcana Women’s Circus.
Additional Equipment
If the Customer wishes to use their own sound, lighting or other electrical equipment such items must be of a standard acceptable to Vulcana Women’s Circus. All electrical equipment brought into the Venue must be tested and tagged according to AS3760.
Failure to Remove Equipment
In the event of the Customer failing to remove the Customer’s goods, Vulcana Women’s Circus may at the sole risk and expense of the Customer remove and dispose of the Customer’s goods from the Event Venue. The Customer agrees to pay Vulcana Women’s Circus the costs of removal and disposal of the Customer’s goods. The Customer acknowledges and agrees that Vulcana Women’s Circus may without prejudice to any other remedy appropriate, sell, and dump or destroy the Customer’s goods which have been so removed.
VENUE CONDUCT
Timing
The Customer will not commence any event earlier or later than the starting time or times specified in the Agreement unless first approved by Vulcana Women’s Circus.
Vacating the Event Venue
Immediately upon conclusion of the Event specified in the Agreement, the Customer will vacate the Event Venue and remove from the Event Venue all of the Customer’s goods, without disruption to the use of any part of the Venue by other Vuclana Women’s Circus.
Sound Levels
Vulcana Women’s Circus reserves the right to exercise control of sound levels which are deemed to adversely affect other activities within the building, or local residents. Sound levels must be kept to a reasonable level at all times.
The Customer’s Personnel
The Customer shall ensure that its Personnel comply with the provisions of the Event at all times and conduct themselves in a manner that is professional and respectful to others.
Display of Posters and Advertising
No posters or advertising materials will be displayed in the Venue or surrounds thereof unless previously approved by Vulcana Women’s Circus.
Cleaning, Waste Disposal
The Customer is liable and undertakes to reimburse Vulcana Women’s Circus for any cost or expense additional to that normally incurred by Vulcana Women’s Circus for the purpose of maintaining the Event Venue in a clean and sanitary condition. The incurring of such additional cost or expense is at the sole discretion of Vulcana Women’s Circus.
TERMINATION AND LIABILITY
Termination
Vulcana Women’s Circus may cancel the Event and will repay to the Customer all sums paid by the Customer under the Event in respect of that part of the Agreed Use so affected if at any time in the opinion of Vulcana Women’s Circus:
· there exists an emergency in the Venue or within the staff team, due to an actual or imminent occurrence that causes or threatens to cause loss of life or injury or distress to persons or danger to the safety of the public or destruction of or damage to property; or
· the Venue is required requisitioned or resumed for the use of a Government or public authority for any public purpose by reason of emergency.
Strikes, Power Failures
Vulcana Women’s Circus is not liable to the Customer or its agents for any loss of income or benefit or any liabilities which may be incurred pursuant to the Event or for any damage or loss or injury caused to the Customer or its agents or to the Customer’s goods resulting from:
· a strike by any employees or contractors engaged or employed by either Vulcana Women’s Circus or the Customer or any other persons or group of persons; or
· any interruption or cessation in the supply of chilled water, electricity or any other type of power or energy to the Venue or failure of any equipment owned operated or Event by Vulcana Women’s Circus.
Law to Apply
The Event will be interpreted and construed and the rights of the parties will be determined in accordance with the laws of the State of Queensland.
Compliance with Laws
The Customer will in all respects observe and comply with all relevant legislation and subordinate legislation in force from time to time.
Jeopardising of Licenses
The Customer shall not do or suffer to be done anything whereby any license or permit issued or in force in respect of the lawful administration or management of the Venue may be or become liable to be forfeited or suspended or the renewal thereof refused.
Compliance with Owner’s Directions
The Customer will forthwith comply with any requirements or direction made or given by the Owner. The Owner will be at liberty to suspend or control to any extent and in any way it may deem necessary any performance or usage which in its judgment is not in accordance with the Event but without rendering the Owner or Vulcana Women’s Circus or any other authorised person liable in damages in respect of such suspension or control.
Inclusiveness of other Terms and Conditions
All Terms and Conditions whether included within this agreement or are included as attachments i.e.; event order / quote, house policy, functions information kits are applicable and are agreed to by the ratification of this agreement when signed by the Customer.
No Assignment
The Customer may not assign any of its rights under this agreement, without the prior written consent of Vulcana Women’s Circus.
When entering the Vulcana space, please make sure to sign in with the QR code at the front door, and sanitise your hands.
During our classes, we may use a range of techniques to limit your movement around the room. This includes:
Please use personal water bottles, gym towels and other items as required.
When seated or standing when entering the building or whilst waiting for your turn, please keep 1.5 metres away from each other.
Utilise hand sanitiser provided.
Wash your hands for at least 20 seconds.
Avoid touching your nose, mouth and eyes.
Managed equipment sharing. Please follow trainer directions.
Limiting contact between students and trainers to safety spotting only.
Cleaning mats and equipment with disinfectant in between uses.
Keep your possessions nearby and avoid touching general use areas unless necessary.
Performance Outcomes
The students in our classes have the opportunity to present in the student showcase or take part in Act Lab, a creative development class at the end of the year, where they learn how to work towards a creative performance outcome. In addition, Vulcana supports students who choose to take the next step to further their circus career with their own creative projects.
